A man arrested after he used the word "bitch" when a woman took his parking space can go forward with a lawsuit against three Las Cruces police officers, a federal appeals court ruled Tuesday...Things may come and things may go, but "Only One" tactics remain the same. Gallegos — contrary to his training, the documents states — "decided to use his own arrest technique in which he grabs and handcuffs the suspect before explaining that he is under arrest."
York reflexively drew back his arm, which Gallegos interpreted as resisting arrest. Gallegos executed an arm-bar takedown and York struck his head and shoulder on the pavement.
Martinez then placed a Taser on York's neck and threatened to shock him if he did not untuck his arms from underneath his body, the documents state.
"I can't. I think you broke my arm," York reportedly responded.

Lawsuit.
Now THERE'S a response that wouldn't have crossed my mind, if you know what I mean.
Here's where I believe the city can be brought back into the suit. If the three cops are still employed by the city after the higher court's ruling. Then the city has willing aided the three cops who have been ruled to have acted outside of their Constitutional duties. By the cops drawing a paycheck from that same job, the city is aiding and abetting the cops.
There's no question the cops are criminals because two federal courts have ruled that the cops have committed civil rights violations against a citizen.
Fact of the matter is, the cops in Rodney King case went to prison and King didn't have $80,000 worth of medical bills.
Could we see justice in such a case? This one seems to be worth watching. One question that was never answered in the story is who is paying for the cops legal cost? If the city is off the hook, is the city still covering legal expenses?
