Actually, it's called Godwin's Law and it is a fallacy. The reason for Godwin's Law is that those who espouse Hitler's philosophies of governmnet cannot effectively refute the comparison. So, they declare anyone who makes a valid comparison to have lost the debate because of "Godwin's Law".

The article referenced in this column goes one better and is trying to label democratic action and freedom of political expression as Naziism, because if they cannot hijack the word to change its definition, as they have done with so many words, then they cannot win the debate.

The invocation of Godwin's Law has not been the success they had hoped, therefore they must try another tactic. That tactic is to attack first with new definition of an old word and reliance upon the majority's ignorance to assume that particular word always meant thus.
