If they presume authority do this in this case, other government agencies can presume authority do it in others.
Another fed agency with an "acting director"...I guess that's one way to keep them unaccountable.

And yes, there's no government agency that feels that any regulation they want is beyond their authoritah.
If the EPA doesn't get you, the FWS will.
