Amicus briefs filed supporting AG in Mississippi gun bill injunction case

Friend of the court briefs were filed yesterday in the Mississippi Supreme Court for the case of State of Mississippi v. Robert Shuler Smith supporting the position of state Attorney General Jim Hood. Last week, the attorney general filed an appeal petition and a motion to vacate an injunction by Hinds County Circuit Court Judge Winston Kidd preventing a law clarifying concealed weapons from taking effect. Smith is the Hinds County District Attorney, who along with a handful of legislators and constables, receiving legal prodding and support from the Southern Poverty Law Center, filed the action to block the new law. This afternoon's Gun Rights Examiner report notes all the legal arguments for why an activist judge and his anti-gun political cronies are either hopelessly incompetent, hopelessly corrupt, or both. They just say it nicer than I do.

The only flaw I see in the Florida amicus is their statement, "Carrying a concealed firearm leads the would-be criminal to believe that a potential victim is unarmed and therefore an easier target for aggression, thus removing all deterrent value of bearing arms." However, as concealed carry gains popularity, it also is a valuable deterrent because the would-be criminal cannot know who is or who is not armed.
