But it Ain't Over 'til it's Over

A federal judge has declared a mistrial in the case against Nevada rancher Cliven Bundy, saying U.S. prosecutors willfully withheld critical and "potentially exculpatory" evidence from the defense. [More]
Sounds good. But the judge admitting that "evidence that was withheld could have been favorable to the accused and could have affected the outcome of the case" raises a big red flag for me.

Acting Nevada U.S. Attorney Steven Myhre certainly comes across like a major villain in this story.

I notice the term 'prosecutorial misconduct' was never mentioned.
