Sounds like a stupid situation all the way around. The witness did say that the shooter did something with his hands before the other guy punched him. But the witness could not see what. So did the shooter start the fight?
Also sounds like the shooter might have been committing a felony under Missouri law, depending on how Missouri defines "under the influence" with regard to carrying a firearm.
Since it sounds like the shooter was trying to pick a fight with comments he made, I don't know that I would give him "Stand your ground" protection. But that is just based on the one witness's account.
The lesson here is to stay out of bars.
