This is interesting. There some misinformation in the news article.
However, the Immigration and Nationality Act specifically gives the Border Patrol authority to enter on any lands within 25 miles of the Border. If Palacios' land is further than 25 miles from the border then they must have permission or a warrant. The crux of this matter might be that Palacios' land is partly within the 25 miles and partly without.
The bad feelings have been going on for some time. 2010 was mentioned in the article.
We'll see how this pans out.
