if a statute burdens some constitutionally secured right, isn't it incumbent upon the State to show how the statute creates some demonstrably greater good, other than "...because it is what we wanna do!", while very narrowly burdening the right in the slightest way possible?
No question about it--the problem is, someone has got to do the appealing and the financing of the appeal, and as far as I know, I'm one of the few bloggers, if not the only one, who regularly posts OFF alerts, let alone urges gun owners in Oregon to join and help with the group's efforts. And I can tell you from private correspondence, like a handful of champions I know who are essentially shouldering a thankless burden with scandalously negligible support, Kevin is carrying more of a load than we have a right to ask of any man.

ReplyDeleteIsn't that the way it is supposed to work?
This should be appealed.
