Coming Monday: Fincher Brief

The foregoing facts are basically undisputed by the Government, just as Fincher does not dispute that he was in possession of the guns, and he had no license issued by the Government for him to do so. What is disputed is whether, as a matter of law, his possession of these weapons has some reasonable relationship to the maintenance of a well-regulated militia.
You can't argue Miller as binding Supreme Court precedent on one hand, and then reject the whole rationale behind the findings of Miller on the other. That is, without admitting the entire judical process is a meaningless scam, where government capriciousness and self-interest rules, and justice for We the People, if attainable at all, is merely a matter of happy coincidence.

Stay tuned. Wayne Fincher's Appellant's Principal Brief has been released. On Monday, WarOnGuns will take you to it.
