NRA's Heller Brief

In arguing that strict scrutiny should not be applied to laws infringing rights guaranteed by the Second Amendment, Petitioners assert that Second Amendment rights are not fundamental” ... In this, Petitioners could not be more mistaken.

As the Framers made clear in the very text of the Second Amendment, they considered the right to keep and bear arms “necessary to the security of a free State.”

  1. Early on, I had the impression that self-promotion was the NRA's major objective in writing the brief, but as it went on, I was pleasantly surprised.

    I found it to be quite well done.

  2. slow at the beginning, but got better. At first glance I thought I was going to have to unleash a verbal attack the next time they called for money, I'll be a little bit nicer now I guess.

    Rutherford Institute also had a good one that discussed the 1968 "law" as well as "saturday night specials" and racial roots of gun control. I have to ask if anyone thinks that would help swing the liberal types up there. Especially given it's an election year and this could come back before the vote....
