8:55, PDT. And now, on the Net, Justice Souter will retire. Is he coservative, or liberal? I honestly don't remember, but if he's conservative, then the Obomination will replace him with a liberal; they'll revisit Heller, and that will be the end of the 2A.

ReplyDeleteBased on some of my readings of Dave Kopel and the speeches I've heard him give, I strongly suspect that his reference to pitchforks was symbolic only. Peasants storming the castle with pitchforks is the imagery. It's just that our pitchforks toss lead at high velocities.

Souter was thought to be "conservative" by some during his confirmation hearings but has, more often than not, voted with the statists. He's no loss.
The probem right now on SCOTUS is that the at-least-somewhat freedom minded justices are young, and the statists are aging. Keep in mind that length of time they typically serve. That means that mostly the statist will be retiring and be replaced by equally bad or worse statists.
And Soetero may get to appoint up to three in the next 3.75 years. So we will possibly have a court with younger statists than the nominally freedom minded members. Unless there is a truly freedom minded POTUS in office when the next round of retirements happen, we could end up with a court much more lopsided than Congress is at the moment.
