Shortly after Sullivan stopped by Trooper David Olney on Route 12, Sullivan sped away from the vehicle stop and drove to his Remsen home with Olney following, according to police.
Sullivan then spent time on his telephone with law enforcement colleagues until he emerged from his home about three hours later, Aney has said. Sullivan was taken to state police barracks where he submitted to a Breathalyzer test.
Sullivan’s blood-alcohol level was found to be 0.09 percent about 4 ½ hours after the initial police stop, according to court documents.
Aney has since said Sullivan’s decision to drive away from the stop and go to his home was proper because it was an attempt to avoid an escalating confrontation with trooper Olney.
