I would be curious to know where the video was taken. Unless the offense committed in their jurisdiction how do they have the ability to prosecute? Can he appeal since he pled no contest? If so this may be a way to challenge the persecution of acts caught on video that did not occur in the jurisdiction charges were filed.
If the offense occurred outside Kalifornia they could infact charge you or me for being in a photo with an assault rifle if the photo was found in Kalifornia.
