Point Noted and Understood

In response to my new GUNS Magazine piece:
It is my understanding from the Heller trial that the finding of individual right was 9/0. The court in turn used that as basis for a 5/4 decision to overturn DC’s gun ban regulations
Yes, and look what four of the Justices were willing to cede passed "individual rights"-recognizing muster. Dan's post-Heller proposals seem consistent with their worldview.  As for his pre-Heller wishlist, who knows what natural or man-made event would be disastrous enough to  exploit as justification for "national security" measures along those lines? Or alternately, who knows what critical mass of the electorate is enough to let those who would rule drop all pretenses and do anything they wish?

  1. we tell jokes, write books and make movies about dystopias where the first vote is 9/0 and the second vote is 0/9.

    is it so hard to understand? if you have anything other than 9/0 and 9/0 then you are suffering middle-of-the-road socialism. it does not and can not work.

    True. But on the other hand who knows how many "Boston Massacres" (Mr. Stewart's random raids) will have to be perpetrated before a segment of the armed part of the populous rises up in armed rebellion? How many "battle of Sipsey Street" scenarios will have to play out before We the People take up arms in defense of our liberty? And it will not matter how tightly the central government controls the news media, the message WILL get out. And when it does, KATY BAR THE DOOR!!!

    Jon, SCOTUS, as envisioned by the Founders was to be the court of last resort. It was expected that SCOTUS would hear cases upon which honest/honorable men would disagree. Thus, 5/4 or 6/3 decisions were expected to be the norm. A 7/2 decision (as in Gore v Bush - the 5/4 was to grant cert) was questionable. 8/1 or 9/0 decisions indicate that the matter should never have had to get that far in the first place. A 5/4 SCOTUS decision is a GOOD, a DESIRABLE outcome, not "middle-of-the-road socialism".
