Always Think Forfeiture Redux*

Yet another agency gets authority to seize cash that might have something to do with drugs. [More]
Quibble: I would replace "gets" with "usurps."

We want something from Holder and he tells us to go to hell.

He wants something from us and he puts us through hell.

And in true dictatorial fashion:
AG Holder’s rulemaking announcement declared that such changes are exempt from the general notice and comment requirements because the department determined that the change does not affect individual rights and obligations.

AG Holder also declared that this rule change lacks sufficient federalism implications to warrant the preparation of a federalism summary impact statement.

  1. Right out of the fifth amendment of the U.S. Constitution,

    "...nor be deprived of life, liberty, or property, without due process of law; nor shall property be taken for public use, without just compensation."

    Forfeiture is unconstitutional and I don't care how it gets sliced up by a court.

  2. Forfeiture without a conviction and a separate hearing is a flagrant violation of the 5th Amendment.
