I watched the pilot episode on NBC.com a week or so back. I enjoyed it, but it is FICTION.
The military (the armed goons who work for the government and collect its "taxes" by threatening death) are called "militia". Actual militia wouldn't be working for the government thugs by collecting "taxes" or enforcing anti-gun "laws", but would be making certain that everyone who wanted to be was armed and trained.
Also, they never mentioned anything about an EMP in the pilot, and hinted that the laws of physics had somehow broken down. It isn't just that all electronics were destroyed/stopped working, but somehow nothing electrical can be made to work even 15 years later. (Except, apparently, the electrical impulses that power neurons.)

Actually, it doesn't surprise me at all that something like this is on a major network. It's great scare tactics. Get the people begging for the nanny state to keep them safe. Get them to gladly trade away even more of their rights for that false sense of security.
