Gun Control Forbidden?

So, what are we going to do about it? [Read]

This link is going around in emails and on social media sites. I'd love to see a Kopel or a Hardy weigh in on it and get their read.

UPDATE: As suspected, this used a real law as a springboard to promulgate a false premise.   I'd heard of the Dick Act--here's the law-- but not the interpretation going around in the emails.

UPDATE 2: My wish was granted. Mr. Hardy blogged "Dick Act mythmaking."  Say that 10 times real fast.

UPDATE 3: Mr. Kopel joins in.

    HR 11654 is a 1949 CIA administrative bill.

    I could not find any listing for
    "The Dick Act" or the "Efficiency of Militia Act" in a cursory search of the library of Congress

    The militia was traditionally any able bodied man. The Dick Act set an upper age of 45 for those who must be militia, not for those than can be militia.

    BTW The Constitution mentions militia, army, and naval forces. There is no mention of an Air Force.
