Guilty Until Prove Innocent?

They would have to be proven constitutional under some form of heightened scrutiny. [More]
Why?  We're the ones who have to prove ourselves now?

How about instead, the burden gets placed on the government to demonstrate where in the Constitution they have the delegated power to even weigh in on the matter, perversions of the "Commerce clause" and other usurpations and tyrannical "precedents" aside?

I keep finding applications for Pynchon's maxim...
