If anyone hands me a gun, even from beneath the counter of a gun store, I am going to act as though it is loaded. Even if I check it myself and see that it isn't, I'll still treat it as if it were. That sure does save a lot of trouble in the long run.
So, although I do see where the gun store clerk messed up for not checking whether it was loaded before handing it to the potential customer, the ultimate blame must lie on the person who pulled the trigger. But, by losing a part of his finger, without any innocent person being harmed, I'd consider things even. He wouldn't get far if I were called upon to arbitrate his case.
Step one: hand gun to customer with action closed Step two: customer looks gun over point gun down range at other customers (remember he is a trained police officer) Step three: rack slide on gun. Step four: pull trigger with gun pointed down range at other customers and with hand over muzzle.
And the trained police officer is sueing the gun shop.
