David, Dear Leader's nominee to replace Scalia is already on record as being in favor of reversing McDonald. Can SCOTUS reverse itself on a prior ruling on its own recognizance or do they have to wait for an appeal to reach them on a similar subject? You're a Lawyer. Do you know the answer to that?

ReplyDeleteI'm not aware of any Constitutional authority to overrule a previous decision without hearing a challenging case.
