Although the incident took place last year, deputies said they couldn’t serve the arrest paperwork until last week. [More]Glad to see they finally had time to do it before getting home at the end of their shift. Lord knows anything that can wait several months merits binding a child and taking him hostage -- I mean, what else could anyone do?
Besides, they were just following orders.

I don't know about Florida but in Texas a nine year old cannot commit a crime. He may do something for which a 10 year (or older) person might be tried and punished but a 9 year old - by definition - cannot commit a crime. One is tempted to speculate that the police waited until after the boy's 10th birthday so that he could be prosecuted but the child's age at the time of arrest would not matter. I wonder if a decent defense lawyer couldn't plead diminished capacity. Autism is a very real thing. I wonder what happened at school. Dollars to donuts somebody in authority tried to physically force him to do something and he lashed out.
