Catch-22

The attorney general’s office counters that, “Turner has not cited any (case law) to support the theory that the First Amendment gives him a right to threaten people passing his home as long as he stays on his property.” [More]
That would be impossible to do, as the First Amendment does not "give" any rights.

You'd think an attorney general's office would know that.

    And the people working there undoubtedly do. But for it to make a difference in their conduct they would have to give a crap. You're almost certainly talking about liberals/progressives. The only laws/rules/etc. they care about are the ones they can use to rain on other people's parades. When the rule affects them they ignore it - most often with utter immunity.
