  1. Under Article II Section 1, the state legislature still has the authority to decide how to pick the electors. They don't have to allow a vote by the people, of course since the 1880's all states have had laws requiring such. There is nothing keeping California from passing a law that allows the state legislature from appointing 56 chimps as electors.
