Lowest Common Denominator for Highest Court in Land

It is understandable for the two parties to oppose each other's smartest nominees, but this comes at a cost.  [More]
I guess it depends upon the meaning of the word "smart" and what benefit is gained. Citing Bork as an example of what could have been, I wouldn't have had it any other way.
