  1. Judge needs to put on his big-boy pants. Any judge has the unquestioned privilege to overrule a jury conviction to declare an acquittal (but not the other way around). If this jury votes for conviction, he could easily overrule them, and don't think he doesn't know this. But he wants the jury to do the dirty work for him so stupid people won't throw mud at him later for doing the right thing.
