Model Second Amendment Resolution for Counties or State Legislatures [More]

Unlike many that we've seen so far, where their hearts are in the right place, this one is based on First Principles and is written by a "lawyer, philosopher & logician [and] strict constructionist of the U.S. Constitution."

  1. I don’t believe I’ve ever seen a lawyer claim in a legal filing that such-and-such was “in violation of the Declaration of Independence,” and would be wary of any one who did.

“Unlike the other founding documents, the Declaration of Independence is not legally binding…”

One can appeal to the spirit of its founding principles, but one cannot appeal to it as a controlling legal authority.
