What I didn't know is his rifle evidently will not be returned to him? What's the story on that?

ReplyDeleteWell, probably the most important reason is that, if I remember correctly, it's not his rifle. Were it to be returned, it would be returned to the owner. However, again as I remember, the owner is still under indictment. So, it is evidence in an active case.
But even if it weren't the case, the DA might fight. Once police offices seize evidence, they are often loathe to part with it. There are a couple of reasons. The first is that there's always a chance that new evidence will result in reopening the case, perhaps with different charges.
The second is that the evidence may have been destroyed or altered. For instance, in the infamous Steven Jackson Games incident a couple of decades ago, the feds seized a number of computers. When the company *did* get them back, they had been disassembled and were largely unuseable (and, by that time, obsolete).
The third is that in anti-gun jurisdictions, they just don't want to, and will make it as difficult as possible. In that case, the process is the punishment.
In general, it's more likely that one can sue to get remuneration for the evidence, since it is a "taking," but even then the DA will likely fight it, so one has to ask if it's worth spending $10,000 to get a $1500 payment
The entire Rittenhouse persecution was a warning to anyone who might consider resisting the Leftist Storm Troops. I am sure that they will continue that with the rifle. The lawyers can decide if a run at the kenosha Leftists is worth the expense and the potential outcome.
