  3. So, does not the 8th Amendment to the U.S. Constitution apply to the states? “Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.”

    Well, I suppose it applies as much as the 2nd Amendment does. In other words, not so much.
