    Calvin Stewart, 47, Salina, walked into the roadway in front of the Wimberley vehicle, causing him to take evasive action.

    Wimberley applied his brakes, coming to a complete stop in the driving lanes.

    McCawley had to come to a complete stop to avoid striking the Wimberley vehicle.

    Henry was unable to stop in time, and struck the rear of McCawley's vehicle.

    Henry, an officer with the Concordia Police Department, was transported to the Ottawa County Health Center, and later pronounced dead.

    Stewart, who was not injured, was arrested at the scene and charged with pedestrian under the influence and second degree murder.

    All law enforcement personnel should be held to a higher standard than us dumb slobs. After all THEY'RE the ones with all the training and expertise. In any incident involving use of deadly force, what would be a simple defense for us should be an affirmative defense for LEOs. The burden of proof should be on THEM to prove that their use of deadly force was justified. I think that if they had to prove in a court of law (both civil and criminal) that their actions were justified we'd see a lot fewer shootings and have lot fewer innocent citizens killed by LEOs.

    Yeah, I know. Fat chance of THAT happening.
