Feigning Ignorance of the Law is No Excuse

It's an absurd and intolerable situation. Those tasked with upholding the law are arresting--and endangering-- those abiding by it. In some cases they're claiming ignorance--in others, they're apparently claiming the power to defy state law and enact and enforce their own. We need to stop it, now, before anyone else's life is disrupted, or God forbid, someone gets hurt or worse.

My Gun Rights Examiner column for today is now up.

Thanks to all of you who have passed the word along about this. It appears to be making a difference, as their political guy told me yesterday the numbers are looking good, so please keep up whatever you're doing.

Use the First, Lose the Second

All he wanted was to talk to his representative about a political issue — something supposedly guaranteed by the First Amendment’s right to petition clause.
"Use the First, Lose the Second," my Rights Watch column for the December 2008 issue of GUNS Magazine, is now online.

Misfired Police Raid Could Have Ended in Bloodshed

There are times when cops really ought to be kicking in doors.

A hostage-taker threatening the lives of innocents unless he gets what he wants?

Go for it.

A terrorist tinkering with poison gas in his basement workshop for the greater glory of whatever?

Hey, let me loan you a sledge hammer.

An elderly man whose grandson unknowingly bought a hot cell phone?

Not so much.

We want to go home at the end of your shift too, guys.

We're the Only Ones Raiding Enough

...and enough, and enough, and enough, and enough, and enough.

That's one persistent group of "Only Ones"...

Enough already!

Making Sure the Next Criminal Act Goes Smoothly

One shot probably would have scared the guys off.
Oh, you know that for a fact based on second-hand hindsight, do you Robert? Since you're using this opinion as the basis for a legal action, perhaps you could provide evidence for your conclusion?

Noting that "Police reports show this year, officers have been to the complex 66 times for burglary, theft and criminal mischief," it sounds like this guy did your clients a favor. What the hell have they done to prepare for incident 67, aside from ensure that the only deterrent that's worked so far has been removed?

We're the Only Ones Talking Out of Your ... Enough

"Prosecutors are investigating allegations that five cops chased a 24-year-old Brooklyn man into a subway station, knocked him down and sodomized him with a walkie-talkie.

Maybe he lifted a finger.

I'm sorry, but the word "sodomy" always reminds me of Groucho's "That's bigamy!" joke.

I will stress that it's legally an allegation at this point, but in this set of circumstances, the New York "Only Ones' " reputation precedes them.

We're the Only Ones Slapstick Enough

With officers in pursuit, the raccoon took off through the house, ripping up Venetian blinds, pulling down drapes, knocking over a lamp and toppling a flowerpot. Finally, Officer Daniel Ek tried to let it out the back door when the suspect apparently turned threatening.

"While unlocking the back door, the suspect ran at Officer Ek," the police report says.
"The suspect"? That's "Only Onese" for a raccoon...?

I'm sorry, but this thing reads like a scene from a "Three Stooges" short. I can just hear Curly going "Woob-woob-woob..." and see them all tearing up the place and hitting each other over the head with shovels as the raccoon outsmarts them at every turn...

Getting the Right Read on Latest Campus Shooting

A librarian at Northeast Lakeview College was shot and killed Monday by a fellow employee, college president Eric Reno said.
Ironic, that in a library of all places, someone can't read...

Guest Commentary: Palm Pistol Unique in More than Design

David:

Many thanks for discussing the ergonomic aspects of the Palm Pistol on your blog. These are the principle issues my design is intended to address.Seniors and the disabled are one of the most vulnerable segments of society and therefore suffer a disproportionate share of becoming victims of crime.I am unaware of any prior attempt to develop an effective self-defense firearm specifically addressing this market.

You may be interested to learn that I am in the process of applying for Durable Medical Equipment (DME) coding for the Palm Pistol. This process is the responsibility of the Center for Medicare & Medicaid Services (CMS).Part of the effort requires a determination by the Food and Drug Administration (FDA) whether the firearm is a "medical device" as defined under 21 USC 321.

I contacted the government attorney who is responsible for these so-called"device/not a device" determinations. When I spoke with him by phone after initially contacting him by email, he explained the reason he had not responded was the fact my request was unprecedented and he did not yet know how this would be handled. He further suggested this was well outside his responsibility and this would have to be decided at the very highest agency level and potentially outside the agency itself. Based on our discussion, while he could not offer any formal opinions, it seemed clear to me the agency could not state in was NOT a medical device. So the bottom line is,the jury is still out.

If I am successful in obtaining DME coding, this would be the first time a firearm could potentially be reimbursable as a DME under health insurance plans if prescribed by a physician for qualified insured's. Although it is unlikely it would ever be reimbursable under Medicare, private health insurance companies may see this as a valuable marketing tool to attract certain customers. I suspect this will make national news.

As an aside, you also may be interested to learn that both AARP and Arthritis Magazine rejected my ads for the Palm Pistol since they refuse to accept anything that relates to firearms. This is pretty outrageous given the likelihood that large numbers of their members support the RKBA and would be very interested in this product. Liberalism has become the new fascism.

I am currently refining my rough legal research notes concerning the DME coding effort. If you have further questions, I would be happy to answer them, and again, thank you for your interest in this novel idea.

We're the Only Ones Young at Heart Enough

Cop booked in rape of 13-year-old was investigated twice for raping young girls, but remained on the job
Well since it's New Orleans, it must be one of those extremely rare bad apple cases...why sure, officer--as long as it's you, I see no problem in surrendering my guns...

But I still haven't received an answer to the question I usually pose when "Only Ones" cases like this come up...

We're the Only Ones Jockeying for Position and Scratching Out a Living Enough

Lt. Kieran Crowe, a 23-year-veteran, was suspended 60 days without pay for rubbing his crotch, simulating masturbation and wiggling his tongue at the male sergeants in his Equal Employment Opportunity office at Police Headquarters.

Crowe admitted at his department hearing that he may have scratched his groin area, but said it was because he suffered from jock itch.
So could you say an "Only One" who is gay and suffers from a tinea cruris infection is a fungi...?

And I do apologize...

It's Time to Play "Fix that Quote"!

Some worry that if John McCain loses and there is suspicion of foul play in the election, violence could ensue in cities with large white populations.
Can you spot the substituted words?

And might those "some" doing all that public worrying have an agenda...?
