Well, this is a New York Slime opinion, and the writer is a member of some "Third Way" organization. Since "Third Way" is a euphemism for fascism, (real fascism, not the way we use the word in political rhetoric) we should not expect due process from the likes of him.
85% of journalist SAY they're libeal. Generally, editorial writers are less so, but this is New York, where they decide what you can eat in restaurants and where you can't smoke on your own property. Heading for no smoking IN YOUR OWN CAR.
