OK, I'll stick with this...what is the (choose one) State's authority to own land?
The Feds handed over huge tracts of said Western land to mining, timber, and railroad companies, who abuse it endlessly. If someone is arguing against Fed 'custodianship', then what are they arguing for? It's intellectually dishonest to argue against something, without putting forth the alternative. Show your cards.
Just fyi, comments are moderated, there's only one of me and I have a life with plenty of other priorities. Patience-- if it's not spam or trolling, which is why comments need to be moderated, I'll get to it.
While alternative control is absolutely a legitimate discussion to have and to settle, that does not invalidate the observation that authority for stewardship is not delegated in the Constitution to the feds.
I respect and appreciate that, David. You and I both introduced potential weasel words (custodianship and stewardship, instead of sticking with 'ownership') into the discussion, but since words matter in the law, I'll try to be more careful. I've resided in Washington, California, Arizona, and now Colorado. I suspect that the folks on the front line of this issue (ranchers, miners, loggers: am I missing anyone?) are far outnumbered by recreational users and preservationists...seriously "outgunned", so to speak. The only parties to this discussion that have the requisite power to swing the balance are our favorite "persons", corporations, using their tool of choice, money. Small-time users (ranchers as well as hikers) are going to lose out in that battle, so be careful what you ask for.
