So now you're guilty of something even without actually DOING ANYTHING?? The who idea of "inchoate" offences scares me. The idea that I can commit a crime just by sitting around with my buds TALKING about doing something illegal without ever actually DOING ANYTHING sounds awfully like thought crime to me. Sedition is a big one in my book. I commit a crime by just talking about taking over part of the government? Or conspiracy. That's a humdinger. A group (of a minimum of 3 under Texas law) sit around talking about doing something and that's a crime? Now if one of the guys in the conspiracy actually goes out and engages in proscribed conduct that's another thing all together. Then the "co-conspirators" can be tried as accomplices before or after the fact. Same with sedition and any other "just talking about something" alleged criminal act. I believe that until and unless someone somebody actually goes out and DOES something, then they have not committed any crime.
Remember the (IIRC) four old farts who sat around at an IHoP drinking coffee and "conspiring" to do something? I'd bet my home that none of them had slightest intention of doing anything. But there they are in prison.
