Another Craigslist Scam

A boutique owner shot outside an East Village deli in July sued Craigslist for $10 million Thursday, claiming his assailant bought a gun through the online classified ad service.

Yeah, well, one problem there:

Weapons and related items, including but not limited to firearms, disguised, undetectable or switchblade knives, martial arts weapons, scopes, silencers, ammunition, ammunition magazines, BB guns, tear gas or stun guns.

Now is it possible to do an end run and post a gun ad? If you use a text ad, it will probably be detected very quickly, if not rejected outright. But if you post a hosted image file, yeah, I could see an ad being up for a couple hours before it's reported and removed. But that still requires the seller and buyer to intentionally disregard a slew of "gun control" edicts.

I'm no fan of Craigslist--their gun prohibition policy alone is enough to turn me off. And it seems every time you turn around there's another headline about scammers and robbers and whores (oh my!)...

If there was ever a place where the words "Caveat Emptor" need to be branded into the frontal lobes...

In a rational world, this lawsuit would be thrown out, the plaintiff scolded and the lawyer warned of sanctions. But who knows? Maybe they'll luck out and get Jack Weinstein...

A Proper Police Response

Risky Business

Are gun owners more likely to kill themselves? Two doctors who think so are asking lawmakers and psychologists to take a new look at the risks of firearms.

So were they gun owners or gun possessors? There's a difference, you know, and the possessor of stolen property is hardly its "owner."

So what attempt was made to identify and separate prohibited persons from the general findings? Because the criminal element--typically lower income, more prone to drug abuse, negativity, hopelessness, lower intelligence, fewer options, more conflicts, more violence, etc.--is hardly representative of the general population.

How does the "gunsuicide" rate cited in this "study" separate out the most heavily armed peaceable demographic on the planet--the 4 million members of the NRA? Has it been empirically demonstrated that we have "a two- to 10-times greater risk of suicide in homes with a gun, both for the owner and for the spouse and children"?

And as long as we're breaking things down to pinpoint correlation of risks with observable populations, what should we do about this inconvenient truth?

Rule 4 Violation?

First, as the NRA’s suit against the San Francisco City Housing Authority, press reports indicate that the NRA will likely dismiss the City & County of San Francisco from the lawsuit challenging a ban on the possession of firearms in San Francisco’s Housing Authority developments. The federal lawsuit sought to overturn both a 2007 local ordinance banning gun possession on county land and a provision in the San Francisco Housing Authority’s lease agreement that prevented residents from keeping a gun on Housing Authority land. Mayor Newsom appoints the Housing Authority. The NRA failed to tie the city ordinance to the lease provision of the Housing Authority, which apparently is a federal agency.

San Francisco City Attorney Dennis Herrera had called the lawsuit “little more than a publicity stunt that improperly names SF as a defendant, and makes false representations to the court,” after the lawsuit was filed. If such is the case, the SF under the loser pays provisions of 42 USC 1988 should file its own request for attorney fees and costs.

We're being told their much-publicized lawsuit fired on the wrong target?

Anybody know anything about this? Because it appears sanctions are being sought, and I haven't seen anything giving NRA's side, either on their site or from any of the many gun bloggers who promote the Association (although in fairness I have not had time to do more than a cursory search).

Although it's long and written more toward policy/legal types than a general audience, the entire article is worth reading for insights and analysis. We've met Irwin Nowick before. His ability to navigate the legislative process and focus on details, connections and implications is impressive, and we ignore his opinions at our peril, because the leading anti-gun legislators in California listen to him with rapt attention.

UPDATE: Here's the complaint. Hopefully those with legal expertise can educate us on what this all really means.

And here's an "About" link for SFHA: "Housing Authorities are unique entities established by a combination of federal, state and local actions. While the Mayor appoints the seven members of the SFHA's Board of Commissioners, the SFHA is an independent agency and a state chartered corporation."

Beats me what this all means--that's why I'm asking for informed opinions.

We're the Only Ones Shocked, Shocked Enough

Former Palm Valley police officer Ramon Martinez is seeking dismissal of the federal indictment against him, alleging that an ATF special agent reneged on assurances that he would not be arrested.

"I was shocked," Martinez, 37, said in an affidavit of his July arrest on charges that he and former Rio Hondo police officer Armando Dueñez bought firearm parts to build assault rifles.

Yeah. Damned BATFU elitists. Whatever happened to professional courtesy? How dare they expect him to obey the same edicts as non-"Only Ones"?
