First of all that's not what the title "expressly states," your preferred phrase appears nowhere in the proposal overview, the rule has not been written yet, and publishing tool headline character limitations and SEO considerations preclude using cumbersome terminology and still getting the point of the article across. Besides, anyone who would decline to read more than the headline is unlikely to be much help anyway.

That said, fair points about the devices, and backed up by the link I "expressly" included in the last paragraph.
