The U.S. Supreme Court affirmed yesterday that police have the power to conduct searches and seize evidence even during an arrest that violates state law.
David Moore was pulled over for driving on a suspended license, a minor offense usually handled with a summons and letting the driver go. Police instead searched the car and found crack cocaine.
The decision was unanimous.
The Bush admin and attorneys general of 18 states agreed, saying enlarging the class of unconstitutional arrests and searches would lead to too much evidence being excluded. "Looking to state laws to provide the basis for searches would introduce uncertainty into the legal system, " they said.
