Knew or Should Have Known

The complaint alleges that less than two weeks before purchasing the Taurus, Badger Guns negligently and illegally sold Fernandez a Masterpiece Arms 9 mm assault weapon, two high-capacity thirty round ammunition clips, and a flash suppressor. [More]


Did Fernandez lie?

Did whatever ID he provided pass the NICS?

When the Brady complaint says "gun dealers should screen suspicious purchasers" beyond the requirements of the law, might doing so to minorities like the criminal involved in this case lead to charges for illegal racial profiling?

When the Brady complaint then says store policy should apply to "every potential handgun purchaser," doesn't that mean in their opinion every gun buyer is "suspicious"--in spite of their earlier assurances that their lawsuit "does not in any way challenge the right of law-abiding citizens..."?


Anybody have details on this that don't involve these jackasses soiling their thongs in anticipation of renewed relevance? Because the major complaint I see here is that the gun dealer being sued is not psychic.

They know--or should know--that type of subversive harassment just steels the resolve of some of us.

Ya I'm confused. Badger was supposed to know that he was a user of narcotics? Are gun dealers supposed to be qualified to make that call? Unless Jose was lighting the pipe at the counter, I see no way they can prove negligence in this case.

It sounds like he passed all the NCIS checks, and then checked that little box on the form affirming that he wasn't under the influence of alcohol or drugs.

To your point David, the section of the complaint that states "...This was evident for, among other reasons just eight days before Fernandez purchased the Taurus, Badger sold Fernandez a Masterpiece Arms MPA930... Assault weapons, high-capacity ammunition magazines and flash surpressors are favored by Criminals, yet Badger sold the Taurus gun to Fernandez". To me, that seems pretty clear they believe that merely wanting to buy a high capacity magazine is reason enough to believe you are a criminal.

Nice catch-22.

Apparently, the Brady Gun Confiscators Lobby has forgotten the 15 USC, chapter 105 - Protection of Lawful Commerce in Arms Act which prohibits the very law suit they've filed.

It seems to me that a lawsuit against the Brady Lobby may be in order since a frivolous suit is illegal as well as costly harassment. I'd say to make Badger Arms whole again would cost the Brady Lobby legal fees and treble damages.

It would be true justice to see the Brady Gun Confiscation Lobby write a nice fat check to Badger Arms.

Badger Guns has been attacked by the Milwaukee newspaper and LEOs over their inability to predict future events, that guns sold to a legal buyer end up being used in a crime and not performing background checks at their gun range. The Milwaukee police chief wanted them to perform background checks on people walking into their store whether they purchased a gun or not.

They've been following the law, otherwise, wouldn't the ATF get involved? They've also cooperated by notifying authorities when felons tried to purchase a firearm.

And they still get vilified.

I see no point whatsoever in trying to rationalise anything coming from the Brady camp: They've proved time & again that rational argument & FACTS play no part in their outpourings, so they deserve nothing more than a curt rebuttal.

As a Jewess in the US, I can only say that STUPID comments like those of the ant-gun "Brady Bunch" are yet another reason why all REAL Americans must put our 2nd Amendment FIRST!
