A More Likely Explanation

In Nassau County, New York, a revised handgun application went into effect in January 2007. A new question asks: “Have you used or still use narcotics, tranquilizers or anti depressant [sic] medication? If YES, record doctor's name, address and phone number, (attach).” If the applicant answers in the affirmative, a list of those medications is also required.

The new question may have been added as a means of increasing public safety, but Nassau County licensees have maintained a nearly spotless record in this area. A more likely explanation is that this could be the next practical step in denying exercise of the Second Amendment.
If it comes from Nassau County, that's the only explanation.

Dr. Paul Gallant and Dr. Joanne D. Eisen talk about a lethal mix: guns, drugs and government.

Nassau Handgun Ban Lawsuit Benefits Gun Owners – AGAIN!

An important new ruling from a New York intermediate appellate court found that the fundamental right to possess a handgun applies in New York. On this point, the court relied on the decision in Chwick v. Mulvey, the lawsuit that challenged Nassau County’s ban on the possession of handguns mislabeled as “deceptively colored.”

...Post-Heller cases challenging New York’s weapons laws, such as Maloney v. Rice, have been unsuccessful because the Court of Appeals for the Second Circuit has ruled that Heller does not apply. This is because Heller reviewed a District of Columbia gun ban and did not explicitly address whether the Second Amendment applies to the states. The Perkins decision, relying on Chwick, is thus highly significant because it bypasses the need for incorporation of the Second Amendment to the states via the Fourteenth Amendment. [More]

I confess to being pretty much ignorant about this. This is what an Internet search turned up. And this Mr. Chwick's website.

Anyone who knows about this and can enlighten us further, please enter a comment.

Microinfringing in Nassau

Nassau County District Attorney Kathleen Rice is urging the NYS Senate to pass legislation requiring semiautomatic pistols manufactured or delivered to any licensed dealer in this state to be capable of microstamping ammunition.

...The bill, A9819A, was sponsored by Assemblywoman Michelle Schimel of Great Neck, cosponsored by Assemblymen Tom McKevitt of Garden City and Joseph Saladino of Massapequa.
Well doesn't it just figure: A Janet Reno protégé using her "official" power to run interference for a radical schlemiel board member of New Yorkers Against Gun Violence.

Yeah, I'll be letting Elena Ceauşescu clones define my rights real quick. Maybe we can negotiate a compromise with them...

Everybody realizes the radical feminist left hates men, right? And yeah, I mean to include "Republicans" McKevitt and Saladino.

Under Color of Authority

The Nassau County local law banning the possession of handguns mislabeled “deceptively colored” has been put on hold indefinitely pending the outcome of a legal challenge by gun-rights activists.
Maybe they don't like "Furious Mike"?

And here's the good part:
It does not grandfather currently owned guns and mandates that gun owners surrender all banned guns for destruction without any compensation, and with no opportunity to sell them outside the county.
Here's what the edict says about that:
This title shall not prohibit possession of any deceptively colored handgun by any person who possesses it on the effective date of the local law enacting this title, or by any person who acquires it by inheritance or operation of law after the effective date of this title, provided that, within thirty (30) days, such person either (i) surrenders such deceptively colored handgun to the Commissioner of Police for disposal in accordance with the provisions of section 400.05 of the penal law; or (ii) modifies such handgun to be in conformance with this title. This title shall not prohibit the possession of any deceptive coloring product by any person who possesses it on the effective date of the local law enacting this title, or by any person who acquires it through inheritance or by operation of law after the effective date of the local law enacting this title, provided that within thirty (30) days such person surrenders such deceptive coloring product to the Commissioner of Police for disposal.
See? You can keep it--for 30 days, or you could, or, hell I don't know. And then you're required to perform either the surrender or the obedience ritual. Kneel before Zod! And if you don't, they can use all the force at their disposal, including killing you if they claim you resisted--and even if you don't, their fear of that is generally enough to make home invasion executions fall within acceptable department use of force policies.

Because, you know, they don't want anybody getting hurt over colored guns.

But then, Nassau County is the same jurisdiction that authorized this bit of juris dicktion.

Squeeze, baby. Keep bringing us that good police state love.

A Future Murder Weapon

"There is no doubt in my mind that there was a future murder weapon in this group of illegal guns. That's a life saved and that's the goal of the police commissioner and my administration," Rice said [More].
Because we all know lives are never saved by having a gun.

Why do Nassau County "Only Ones" carry them again?

And if you don't turn them in, they'll figure out an excuse to come take them.

Much Ado about PR

"We Want AR-15s" - GOP Nassau Executive Announces Gun Drive To Send Weapons To Ukraine [More]

Doing the drive before figuring out State Department sentiment, arms export permitting requirements, and logistics strikes me more like a politician's hollow publicity move than anything.

We're the Only Ones Still Hazy Enough

Police weren't saying who fired the shots, who was hit and how badly that person was hurt. At least one man was hospitalized. It also wasn't immediately clear if the shooting happened inside or outside of the bar. [More]
Regardless, the prevailing sentiment and most state laws say cops are the "Only Ones" who can be trusted with guns in bars. Heck, a simple Google search'll confirm that, right?

Case in point. "Community service." Nassau.

Lesser-known SAFE Act lawsuit raises unique points and risks for gun rights

“The Court ordered the return of Razzano’s long arms [but] after years of litigation ... Razzano is still ‘ineligible’ for a Nassau County pistol license, and thus under the SAFE Act is subject to having all of his ‘weapons’ confiscated, including hunting rifles and shotguns for self-defense in his home,” the current Razzano lawsuit explains. [More]
Today’s Gun Rights Examiner report notes an overlooked case that deserves attention for no other reason than one of basic justice.

Chwick v. Mulvey Update

At this time, it is very important to stress that the Second Department's excellent ruling established that all local handgun control laws are preempted by state law, possibly opening some very strong arguments to challenge other local gun laws. However, if Nassau should appeal, to the New York Court of Appeals, and we are unable to respond because of lack of funds, then there is a real chance of us getting a ruling going the other way that has effect throughout the entire state. [More]
You can learn more about the case, including how to donate. Make sure your friends in NY know about it.

Ding-Dong Bi...uh...Ditch

Former Bronx prosecutor Bernadette Greenwald, 37, of Rockville Centre, Long Island, told Nassau County police she felt she "had balls" after firing the gun for the first time after the game of "ding-dong ditch" caused her to snap, the New York Post reports. [More]
I wonder if she also felt like she had balls when prosecuting New Yorkers on gun possession charges?

We're the Only Ones Who Can Hit the Side of a Bus Enough

A few years ago on Long Island, an off-duty Nassau County police officer providing security for a jewelry store took off in pursuit of an armed robber through Garden City, N.Y.'s Roosevelt Field Mall. When the chase led outside, the officer drew his gun and fired, only to hit the side of a school bus full of handicapped elementary school students.

What is it with "Only Ones" and the disabled...?

This is just a bit of prep work by the International Council of Shopping centers for their upcoming "Mall Violence Conference." As per usual, it will be steered to foregone conclusions by risk managers who wouldn't have a clue on how to respond were they under fire, and the consensus will be the American consumer will tolerate damn near anything, so metal detectors and physical searches will become a cost of doing business and a accepted way of life.

We're the Only Ones On the Job Enough

Despite the Internal Affairs investigators finding a year ago that DiLeonardo committed unlawful acts including assault, criminal use of a firearm and driving while ability impaired, he has not been criminally charged and remains a Nassau County police officer. [More]

Another Look at Freeport Gun Seizure

A member of the Minuteman Civil Defense Corp. is suing Nassau County to get back nine rifles and 15 handguns seized from his Freeport home by police after he made repeated visits to the office of Rep. Carolyn McCarthy to complain about what he believed to be "illegal aliens" in his neighborhood.

Aides to McCarthy (D-Mineola), whose husband was one of six people slain by Colin Ferguson in the 1993 Long Island Rail Road massacre, eventually called police, which led to the seizure of the weapons.
"Freeport gun seizure." Now there's an oxymoron.

We discussed this story the other day.

I've been in touch with Mr. Razzano. I spent about 20 minutes on the phone with him yesterday afternoon, and he briefed me on the background of the case as well as sent me some corroborating information. Here's the thing: because there is a case pending, we need to make sure his legal interests are protected and not jeopardized by premature or imprudent disclosures. As such, I've promised him that no information will be released here without his express consent, allowing him to vet things with his lawyer to make certain our desire to share the truth doesn't harm his chances of having his property returned or that his ability to obtain justice isn't diminished.

I'd also like to add that I was the one who volunteered presenting things this way--Mr. Razzano made no demands. I don't want to be responsible for hurting someone I'm trying to help.

It's a story of official arrogance and abuse of a citizen's rights that I still have trouble accepting, only because it is so outrageous and un-American. I hope to be able to disclose more next week, but will be playing everything by ear. All I can say now is stay tuned, and please understand the need for these self-imposed constraints.

In the mean time, after reading the title-linked NewsDay piece, feel free to leave a comment on their site--the more reader interest they see, the greater the likelihood they'll stay on top of this story.

We're the Only Ones On a Spree Enough

A Nassau County corrections officer was arrested Wednesday after a shooting rampage that killed her former lesbian lover and uncle and injured her grandfather, cops said. [More]
See? If we can't even trust a government-employed guardian with a gun, how much less trustworthy are you?

Don't Mess With the Tyrant

An outspoken Long Island gun owner's home was raided by Nassau County detectives, who seized two dozen weapons he lawfully owns just one day after Rep. Carolyn McCarthy's office made a 911 call about him.
Maybe he mentioned "barrel shrouds" and not knowing what they were, she freaked?

If credible threats were made, let's see the charges for them. Let's see Mr. Razzano arrested and charged, then tried and convicted.

This just stinks of Soviet-style tyranny.

I know others are blogging on this as well, but I'm not seeing any new information. If you have knowledge to add, please do.

We're the Only Ones Getting Into the Christmas Spirit Enough

Nassau cops deployed a new surveillance system Saturday night in Uniondale, videotaping the revelers gathered to see the annual lighting of RexCorp Plaza's Christmas tree.

We know when you've been sleeping
We know when you're awake...

Come to think of it, this reminds me of another Christmas song, too...

Stink. Stank. Stunk.

And what say we nominate Susan Dolan for a special Eloi Award?
