Wayne Fincher Update: Case Submitted to SCOTUS

On Friday, 19 December 2008, a Writ of Certiorari was submitted to the U.S. Supreme Court in the matter of U.S. v. Hollis Wayne Fincher. The Writ asks the Court two fundamental questions...[More]
I understand there is no shortage of those not only willing to throw Fincher under the bus, but are actually resentful that he will hurt us all.

Nothing his critics propose will change the law regarding machineguns. They are the first ones who caution against even discussing it up, because the time is not right.

When such time will be right isn't even a matter of speculation, because we all know that time will be "never." We won't change federal law on this through majority rule, and the Supreme Court has created the circular room of "common use" and told us to relieve ourselves in the corner.

We can argue about the merits and the wisdom of Fincher's case until the cows come home, but that doesn't change a few inconvenient truths: He's fighting for his life. Those who want him not to are literally wanting him to roll over and give up for their sake.

The real outrrage is that the Second Amendment has been denied by those in power, and the Constitution has been ruled inadmissable in court.

For me, at this point, here's all that matters: A good man is in big trouble. My conscience demands I do what I can to help him. Besides, I'd just as soon know that the answer is an unequivocal "No," as opposed to continuing to delude myself that the path that led us to the Obama administration is the one that leads to "shall not be infringed"--or can't I make that reference without ridicule either?

AMEN!

Prayers for sanity in the members of the court sent out.

Now...this is going to cost some cash, I assume for now that the defense fund at:

The Wayne Fincher Defense Fund
P.O. Box 215
Elkins Arkansas 72727

is the place to send things, like wheelbarrows full of NRA cash, correct?

Yeah, that's what I thought, but figured here in comments too, just in case folks didn't click through.

For Wayne, Miss Linda, and myself:

Thank you, David.

This has been, and continues to be a long hard road, but certainly easier than outright tyranny and civil war.

For those critics of Wayne:

When was the last time you inconvenienced yourself to actually go out of your way to help someone else?

In all the years I've known Wayne, he has never failed to help in time of need. If needed, he would literally give the shirt off his back. Wayne never just spoke the words, he actually followed through and did what he said.

Can I fail to help such a friend? Can you?

At the very least, Wayne's case has exposed the raw, ugly truth of where we are really at.

He ought to be thanked for that if nothing else.

By the grace of God we will get through this. We still need your support, as that is how the LORD works — through men.

This is by no means over. Come January 20th, Judge Hendren gets to find out that 120 acres of landlocked property isn't worth a plug nickel.

SA, if you're out there: My apologies. Regrettably, you were right about Heller, and I was wrong.

We know with 100% accuracy that the case would turn out badly- it would be funny to read the justices' doublethink though. Hopefully, the defense would mention the "every terrible instrument of the soldier" quote.

This case is a beautiful litmus test.

We all know that under the rules of the federal government, machine guns should be legal and unregulated. The NFA is blatantly unconstitutional, by the admission of the Supreme Court.

If they play by the rules they set for themselves, then perhaps there is still the possibility of electoral recourse.

If they do not, then we know that all the campaigning, voting, protesting, and rallying we may do is simply a waste of time better spent arming, shooting, training and preparing.

It's a sad truth that I have no faith whatsoever in the former outcome.
