Hmmm... A certified Instructor, certified by SLED no less, and a bearer of the Magic Shield to boot, is using the "I didn't know it was loaded" excuse?

We cannot know that.
We can know, and do know for a fact, that he was unaware that the chamber was empty, which he should have determined before proceeding, but obviously did not.
The idea of someone not knowing it was loaded can't usually be proved or disproved, but the failure to know that it was empty proves itself by the bullet hole in the victim.
"Your Honor, I didn't know it was loaded!"
"I'm not sending you to prison because you didn't know it was loaded."
"Thank you, your Honor!"
"I'm sending you to prison because you didn't know it was empty."
Huh?
Rule 1: All guns are always loaded.
Rule 2: Never let the muzzle cover anything you are not willing to destroy.
Rule 3: Keep your finger off the trigger until your sights are on the target.
Rule 4: Be sure of your target.
