Even though this causes no injury, it is still using force to make other people comply. I would respond with an equal level of force, like maybe a kick to the shin. Shoot planning ahead, I bet this device doesn't prevent me from blowing a police whistle.

It can be beaten with a little practice. All this is is a directional sound system which plays back what you've said to yourself a a split second after you've said it. Anyone who's been on a crappy long-distance phone call which echoed your words back has been affected by this sort of thing. After a few seconds adjustment, you can just carry on the conversation as per normal.

And, no, it doesn't affect anyone who just makes noise, such as howling or saying "blah blah blah", etc.
