Unfortunately, (and respectfully) this is the result of Allen Gura conceeding huge ability of the government to regulate in his opening arguments in Heller.
In essence, Mr. Heller offered the government huge areas of potential regulation in exchange for a regulatable limited individual right.
Regretably, the Heller court was as "good" a composition for the limited decision as we are likely to ever see again in our or our children's lifetime(s).
