As I have mentioned in a comment somewhere before, it's getting easier to predict the outcomes of certain court cases based on the perceived interest in government to maintain certain precepts foreign to the Constitution. Cases like this one and others I allude to can be seen to support the thought that there really is no separation of the branches of government in it's original concept as so many cases seem to point to a partnership.
