If he says, "No," he is lying to a police officer, which is a crime. If he answers truthfully, "Yes," he has just incriminated himself. So what's a person to say? [More]Seems to me Haynes v. I'd say, "Lawyer! Now!"
"I need to speak to a lawyer". Seven magic words that will stop all questions. Taking the 5th only stops the current question and they are free to keep asking. Of course they will probably arrest and search you before that trip to the crossbar motel. Like you said, damned if you do, damned if you don't.
I prefer intelligent conversations. Therefore I don't talk to pigs.
