It fell out of his pocket, he picked it up, he got shot by LE who falsely claim he pointed it at him. Problem is they probably did see what didn't happen.

I'm on the fence about the criminal matter, but leaning towards 'no-bill'. It's clear there was no criminal intent.

If there is a civil suit, it's open and shut. A man got killed for doing nothing illegal or even morally wrong.
