So while the lead opinion initially would have reversed the conviction, because the court split evenly, 4-4, McLemore’s conviction in the trial court still stands. [More]All this and no warrant. Sounds like just the kind of thing the governed would consent to, no?

Well, if it does become criminal, nothing really changes. Under current practice, police will kill you if you are insufficiently submissive. I call it "Failure to Grovel". Daniel Shaver comes to mind, among others.
