Serious Allegations Require a Serious Investigation

Received via email:
I contacted you via e-mail, several years ago, while my dad was appealing his case... My dad's appeal was not successful, but I am determined to expose the crimes that ATF Agent [name redacted] has carried out, which has resulted in my dad having a life sentence in prison. Our lawyer has authorized me to share this information with you, and asks that you assist us, as we work to prove my dad's innocence.
I recall that correspondence. It involved the conviction and life sentence of an Arkansas doctor on bombing and weapons charges.

At the time, I advised my correspondent that it would be irresponsible and potentially damaging to his father's defense to post information without the attorney's cognizance. This email relieves me of that burden and I have posted the attachment alleging ATF misconduct at Scribd.

Very serious allegations include:

  • The fabrication and planting of evidence by the Government/ATF Agent(s) and their confederates, where a box of 40mm HE grenades was planted near my house and used by the government to obtain a search warrant of my house, office, and property, to incarcerate me prior to trial, deny my bond, obtain my conviction and that of my spouse on obstruction of justice charges, all consistent with “fraud on the court”.
  • Cover up by the District Court and Eight Circuit Court of Appeals in an attempt to keep the “fraud on the courts” from being litigated and hence exposed, even going as far as calling the overtly fabricated evidence as being “overwhelming evidence of my guilt”. While at the same time denying me any form of hearing, which prevented me from exposing the Government’s egregious conduct.
  • Prosecutorial misconduct by the United States Attorneys and Assistant United States Attorneys, Eastern District of Arkansas who along with their confederates in law enforcement, suborned perjured testimony from numerous individuals, knowingly using it in the legal proceedings, having the executive office for the United StatesAttorneys withhold data and documents that I have sought since May 13, 2013, that were withheld by the government in violation of the Brady and Giglio.

It must be emphasized that these are allegations. That's why the evidence the document claims needs to be weighed against trial documents.

That's a much bigger job than I'm prepared to take on, with no resources and no time to take on the task of unraveling all the details and claims from both sides.  It would be full time and open-ended and would require putting all of my own priorities on hold to assume someone else's, all unfunded and with an unknown outcome. On top of that, I'm totally unqualified to weigh in on the physical evidence presented with an informed opinion.

What's needed is a real investigation, and I doubt House Oversight under a Democrat majority would be so inclined. And that's a shame because this could end up being a headline-worthy case of grave injustice that demands exposure and correction. I don't know, and that's kind of the point.

Candidly, I'm at a loss as to what more can or should be done.  I will leave the Scribd document posted so that, perhaps, someone who can advance it will pick up the ball from here. If you are such a person, send me a note via the sidebar Contact Form and I'll put you in touch with my contact, the son.

In the meantime, I'll pass this on to some attorneys I know and see if it intrigues them to find out more.
