Which section of the Constitution delegates them the authority to do that? And which authorized branch of government would "control" it?

It might help to see how ol' Cass would tie that in with all his other control freak dreams, like banning hunting, banning and taxing "conspiracy theories" (as defined by him), and creating a "second bill of rights" where they're bestowed (or withheld) by government.
