Only because of criminals in government not obeying the clear intent of the Constitution. And even here, it's up to the victims to bear the burdens of a challenge to make the persecution stop. And you'd better believe the abusers, who won't be expending their own resources, will find workarounds and throw up interminable legal roadblocks to discourage most from trying.
