“[T]he court finds that defendant did not breach the Settlement Agreement, but did breach the covenant of good faith and fair dealing,” Senior Judge Francis M. Allegra noted, characterizing Dobyns’ ordeal as “Kafkaesque” with no-nonsense candor revealing he is not at all pleased with government conduct. “Based on the breach of the covenant, the court finds that plaintiff is entitled to damages in the amount of $173,000. It's almost surreal when figures from Operation Fast and Furious appear in this account, and they act in character consistent with how they established themselves in that story. This time, with additional “cast members” (and the legal document at times reads just like a script), the technique of “slow walking” (as in deliberately dragging their feet investigating the arson of Dobyns’ home) brings to mind another “walking” technique employed by ATF in that other installment of the bureau’s directed misadventures. In this photo I was holding up the "Mr. Codrea" place setting card and explaining the only people I expect to call me that are the wife and kids, and they just laugh.

How we got from there to here.  This is really a good behind-the-scenes narrative.

I am painfully aware of some friends who do not accept the new "here."  I can tell you this much from discussions I am not at liberty to share in detail: This came from the heart of Alan Korwin and those he credited with assistance. It was not directed and controlled and finessed from "on high."

I do see one assertion I expect to be contested:

Some of the writers, apparently led by Claire Wolfe, considered taking the group over, but they lacked the resources to do so.

I do not have specific knowledge of what that entailed or what resources were on the table. I won't be surprised to hear more on that from The Zelman Partisans, and if a rebuttal is presented there, I'll make sure and link to it from WarOnGuns.

This is tangentially-related, but it's not part of my promotion of Korwin's piece, so I'm fine-printing it to set it apart:

There's one other personal note I think it's important to add -- In group discussion, I requested clarification if there is any topic I am prohibited from writing about for JPFO, or any desire to pre-approve or censor what I say. Alan Gottlieb assured me I am free to continue as I have been since before the merger took place. Naturally, I would not abuse that with an attack against the group or any of its leaders, or anything that runs counter to the mission and principles of JPFO, and expect it to be posted on their website -- If I feel that strongly, it will be time for me to leave and do the criticizing from my own house, not theirs.

I've seen comments posted around that my association with JPFO could make people perceive me as being a "sellout," particularly since I have not joined in on some of the more scathing criticisms of Gottlieb, some leveled by good friends of mine.  If anyone is dishonest or dumb enough to buy into that, I can't get too worked up over it, because that type attacks me all the time. Anybody who thinks I do this to be popular hasn't been paying attention.  I have some big differences with Alan, and he knows about them (my friend Dave Workman and I are polar opposites on this, for instance), and I'd have written about what I consider to be a "new paradigm" this week except the breaking Dobyns story and another tip I'm tracking down requiring immediate attention and focus.

I'll disagree with anybody when I think an alternative voice merits being heard. If that means it makes people -- any people -- want to have nothing to do with me, so be it.

‘Special Master’ Order and Replacement of Judge Suggests Fix is In on Dobyns Case

Think of it this way – if the government can eat one of its own like this when he strays from the reservation, think what they can do to any of us. If the system does not provide for a fair trial for someone you don’t care about, how can it provide one for those you do care about? If a fair trial is impossible, that means checks and balances are gone. Piling on the guy fighting against that is not in the interests of anyone except the ones who would rig the system, and the ones who would take that as a green light for corruption and abuse. [More]

Much Ado About Nothing

The Department itself has already publicly revealed the sum and substance of the very material it is now seeking to withhold. Since any harm that would flow from the disclosures sought here would be merely incremental, the records must be produced. [More]

It's not like they're going to bring out anything related to Kevin O'Reilly or what Hillary's people must have known about in order to preclude an ITAR violation, or about what Holder knew the night Brian Terry was killed-- and then lied about.

Plus, the judge "did leave open the possibility that some of the documents containing sensitive information related to foreign policy or law enforcement, or which dare covered by attorney-client privilege, could be withheld," and "The administration can appeal the ruling."

But keep acting like you're some kind of pit bull for justice, Jason Chaffetz. You've been useless on Twin Peaks and useless on helping Jay Dobyns, and you've essentially done next to nothing with what Darrell Issa turned over to you on Gunwalker. But yeah, go ahead and pledge how you're going to keep on keeping on until you get to the truth.

Like I said, yawn.
